The agreement, in plain terms

These Terms of Service ("Terms") are a legal agreement between you and MotoSetGo LLC ("MotoSetGo," "we," "us," "our") governing your use of the MotoSetGo mobile application and the website at motosetgo.com (together, the "Service").

By downloading, opening or using the Service, you agree to these Terms and to our Privacy Policy and Safety Information, which are part of this agreement. If you do not agree, do not use the Service.

If you are using MotoSetGo on behalf of someone else, you confirm you are authorised to accept these Terms for them.

MotoSetGo reasons from the symptom you describe, your motorcycle's published specifications and the rider profile you enter, and suggests where to start. It is guidance, not a diagnosis, and not a substitute for professional inspection or service.

It cannot see, hear or measure your actual motorcycle. It does not know the true condition of your components, whether a part is worn or damaged, whether a fastener is loose, or whether a previous repair was done correctly. Its recommendations are a well-reasoned starting point for you to test — not a verdict.

The Service is intended for licensed motorcycle riders. By using it you confirm that:

• You are old enough to form a binding contract where you live (at least 18, or the age of majority in your jurisdiction), or you are using it with the involvement of a parent or guardian who agrees to these Terms;
• You will use the Service only for lawful purposes and in accordance with these Terms; and
• The information you enter (such as your bike and rider profile) is accurate to the best of your knowledge, since the quality of the guidance depends on it.

MotoSetGo is not directed at children (see the Privacy Policy, §8).

MotoSetGo has no user accounts. You never create a username or password and you never sign in. The app uses an anonymous identifier stored on your device to associate your data with you; how that works, and what it means for your data if you change devices, is described in the Privacy Policy (§1). You are responsible for the device and store account you use to access the Service.

MotoSetGo is free to use for 30 days. After the free period, continued use of the paid features requires a subscription.

Current plans (the price shown in the store at the moment of purchase always governs):

Prices are in US dollars; the equivalent local price and currency are shown in your store at purchase. We may change prices for future subscription periods; where required, the store will notify you and ask you to agree before a changed price takes effect.

How billing works — please read this part:

• Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
• The subscription renews automatically. Unless you cancel, it renews for the same period at the then-current price, and your store account is charged for each renewal.
• Automatic renewal can be turned off, and the subscription cancelled, in your store account's subscription settings — not in the MotoSetGo app, because we have no account to cancel. To avoid being charged for the next period, cancel at least 24 hours before the current period ends.
• Free trial: if you begin a paid subscription, any unused portion of a free period is forfeited at that point, where the store applies that rule.
• The free period is provided by MotoSetGo, not by the stores. It's tracked by the app on your device, and needs no subscription and no payment details. After it ends, continued use of the paid features requires a subscription.

We never see or handle your payment details. Card numbers, billing addresses and names are handled entirely by Apple or Google and are never transmitted to us. We use RevenueCat only to learn whether a subscription is active and which tier — see the Privacy Policy (§5).

You may cancel at any time in your store account's subscription settings. Cancelling stops future renewals; it does not retroactively refund the current period, and you keep access until the period you've already paid for ends.

Refunds are handled by the stores, not by us. We do not process payments, so we cannot issue refunds directly. Refund requests are subject to Apple's and Google's policies:

• Apple: request a refund at reportaproblem.apple.com.
• Google Play: request a refund through the Google Play refund process.

Nothing here limits any non-waivable refund or cancellation right you have under the consumer law of your country (for example, EU/UK withdrawal rights).

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own motorcycle-tuning purposes, subject to these Terms. You agree not to:

• Copy, scrape, extract or redistribute the MotoSetGo catalog, specification data, diagnosis content or any other part of the Service, or build a competing or derivative product from it;
• Reverse-engineer, decompile or attempt to derive the source code, the diagnosis engine or the underlying data, except where that restriction is prohibited by law;
• Circumvent, disable or interfere with the paywall, entitlement checks, rate limits, security or any technical protection in the Service;
• Access the Service through automated means, or in a way that places an unreasonable load on our infrastructure;
• Use the Service unlawfully, or to infringe anyone's rights.

We may suspend or limit access that violates this section or that threatens the Service or other users.

The Service — including the app, the website, the MotoSetGo name and branding, the motorcycle specification catalog, the diagnosis engine and its logic, and all text, layout and design — is owned by MotoSetGo LLC or its licensors and is protected by intellectual-property law. The catalog and diagnosis engine are proprietary. These Terms grant you a licence to use the Service, not any ownership of it. Motorcycle makes, models and manufacturer names are the property of their respective owners and are used only to identify the bikes the Service supports; MotoSetGo is not affiliated with, endorsed by or sponsored by any motorcycle manufacturer.

To the fullest extent permitted by law:

• The Service is provided "as is" and "as available," without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
• We do not warrant that the guidance is correct, complete or suitable for your specific motorcycle, and specification data cannot be perfect for every model, year and market. Where our figures and your owner's or service manual disagree, the manual wins.
• We do not warrant that the Service will be uninterrupted, error-free or secure, or that it will be available at any particular time.

This section works together with the Safety Information. A suspension change alters how a motorcycle behaves. The decision to make a change, and to ride the motorcycle afterwards, is yours alone.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you; in that case those warranties are limited to the minimum the law permits.

To the fullest extent permitted by law, MotoSetGo LLC accepts no liability for any injury, death, loss or damage to persons or property arising from your use of the Service or from any adjustment, service or riding decision you make in connection with it.

Neither MotoSetGo nor its owners, members or suppliers will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising out of or relating to the Service. Where liability cannot be excluded, our total aggregate liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) US $50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law (including, in some jurisdictions, liability for death or personal injury caused by negligence, or for fraud). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

To the extent permitted by law, you agree to indemnify and hold harmless MotoSetGo LLC and its owners, members and suppliers from any claims, damages or costs (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party. This does not apply to claims arising from our own wrongdoing.

We are actively developing MotoSetGo and may add, change or remove features, and may update the motorcycle catalog and the diagnosis engine, at any time.

We may also update these Terms. If we make a significant change, we'll update the effective date above and, where appropriate, tell you in the app or on the website. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you don't agree to a change, stop using the Service and cancel any subscription through your store account.

You may stop using the Service at any time, and cancel any subscription through your store account (§6). We may suspend or end your access to the Service if you materially breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination — including §§8–11, §14 and this sentence — survive.

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules, except where the mandatory consumer law of your country of residence gives you additional protections that cannot be waived — those continue to apply. The state and federal courts located in Illinois will have jurisdiction over any dispute, to the extent permitted by law; EU/UK and other consumers may also have the right to bring proceedings in their own country.

If you download MotoSetGo from the Apple App Store, the following also apply, and Apple requires them:

• These Terms are between you and MotoSetGo LLC only, not with Apple. Apple is not responsible for the Service or its content.
• Your licence to use the app is a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app. Questions go to us at admin@motosetgo.com.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
• Apple is not responsible for addressing any claim by you or a third party relating to the app, including product-liability claims, claims that the app fails to meet a legal requirement, and claims under consumer-protection or privacy law.
• Apple is not responsible for investigating or resolving any third-party intellectual-property claim relating to the app.
• You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist-supporting," and that you are not on any US Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

These Terms, together with the Privacy Policy and Safety Information, are the entire agreement between you and MotoSetGo regarding the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor (for example, if the business is sold or merged — see Privacy Policy §11a).
